The law in relation to gaming machines is complex - see information for applicants for further details.

Overview

Alcohol-licensed Premises - There is an automatic right for licensees to provide up to two machines subject to a simple notification procedure.

For premises with more than two machines, licensees must apply for a Gaming Machine Permit.

(NB.  Gaming machines may only be provided in premises which have a separate bar and where there is no requirement for alcohol to be consumed as part of a table meal.  This effectively excludes restaurants and cafes).

Members' Clubs - To be considered as a Members' Club under the Act, a club must have at least 25 members and be set up for a purpose other than gaming.  Gambling in such clubs may be provided with the following permits:

• Club Machine Permit - this will entitle a club to offer up to three gaming machines in categories B3A or B4 to D.
• Club Gaming Permit - this will entitle a club to offer up to three gaming machines in categories B3A or B4 to D plus facilities for equal chance gaming - subject to certain limits.
