Tier 2 Local Restrictions Support Grant (Sector)

The Local Restrictions Support Grant (LRSG (Sector)) supports nightclub, dance hall or adult entertainment businesses that have been closed due to the national restrictions.

Businesses that have been required to close due to the national restrictions introduced in March 2020, and which have not been able to re-open, may be eligible for LRSG (Sector).

Eligible businesses are entitled to a cash grant from Torridge District Council for each 14 day period they are closed.

Eligible businesses include:

· Nightclubs, dance halls, and discotheques

· Adult entertainment venues and hostess bars

Your business may be eligible if it:

· is based in England

· occupies property on which it pays business rates (and is the ratepayer)

· has been closed since 23 March 2020 because of national restrictions

Eligible businesses can get one grant per non-domestic property.

Businesses excluded from the fund

You cannot get funding if:

· you have re-opened as another type of business (for example, changing a nightclub to a bar)

· your business is in administration, insolvent or has been struck off the Companies House register

· you have exceeded the permitted state aid threshold

You must notify your Torridge District Council if your situation changes and you no longer meet the eligibility criteria. For example, if you become insolvent.

What you will get

The grant will be based on the rateable value of your property on 1 November 2020.

If your business has a property with a rateable value of £15,000 or less, you may be eligible for a cash grant of £667 for each 14 day period your business is closed.

If your business has a property with a rateable value over £15,000 and less than £51,000, you may be eligible for a cash grant of £1,000 for each 14 day period your business is closed.

If your business has a property with a rateable value of £51,000 or above, you may be eligible for a cash grant of £1,500 for each 14 day period your business is closed.

The grant will be extended to cover each additional 14-day period of closure.

State Aid Regulations

The grants issued to businesses in response to the COVID-19 outbreak are classed as 'state aid.'

State aid is when taxpayer funded resources are used to provide assistance to one or more organisations in a way that gives an advantage over others. 

As part of your application, you will be asked to confirm that your business will not exceed the state aid limits, as set down in law, if the grant is paid.

You will need to confirm how much state aid you have received within the current and previous two financial years. If you are not sure if help you have received qualifies as state aid, you should contact the awarding body or seek independent advice.

For the avoidance of doubt, any grants received from the Council would be considered state aid and you will need to declare these on your form.

You will also be asked to confirm that you are not an 'Undertaking in Distress' (within the meaning of Article 2(18) of the General Block Exemption Regulation) on 31 December 2019).

Making an application

This application is provided to capture the information required by Torridge District Council to verify and make the payment of these grants.

Please make sure you follow the instructions very carefully and add the information exactly as it is laid out on your business rates bill.

Please ensure you have the following information with you before you start your application:

· Your business rate account number and the name of your business as it appears on your rates bill

· Your Company Number (as registered with Companies House) if a limited company

· Your VAT number if VAT registered

Payment will be by BACS transfer to your nominated bank account.

Please note the payment(s) may take up to 5 working days to clear into your account.

Please note that you must notify us immediately if your circumstances change and you no longer qualify for this grant. For example, you open for trade or your business ceases to trade completely.
